New law on car accidents in Panama

 Executive Decree No. 958 of December 10, 2010, published on Monday 13 in the Official Gazette and shall take effect starting tomorrow. Abstract:

- As of tomorrow must have in your car the only definitive Format Transit. (report form)

- When a vehicle collision, take photos and move your vehicle from the street, if not injured.

- Drivers complete a single, definitive Format transit, indicating who is responsible. If you do not agree to call the traffic there for the agent to draw up the party, based on the pictures and the format (Art. 6)

- If drivers do not move their vehicles, they are fined $ 50.00 (s. 7)

- The format should be sent to the CIA. Insurance for processing the claim (art. 8)

- The natural or legal persons entrusted with the responsibility may request the removal of part of policing within 8 days following the accident. In these cases we will return the party to the Traffic Court (Article 9)

- After preparing the format you have 8 days to challenge the format (art.10)

- But before the insured challenge the format must first assess the claim (Article 11)

- If your car has no policy will be fined $ 100.00, if the driver does not carry a copy of the Policy the fine is $ 50.00 and it holds the vehicle.

This decree begins to run from the enactment.



Decreto Ejecutivo No. 958 de 10 de diciembre 2010,   publicado  lunes 13 en la Gaceta Oficial, y que comienza a regir mañana.  Resumen:

- A partir de mañana tiene que tener en su vehículo el Formato Único y Definitivo de Transito.
- Al momento de colisionar un vehículo, debe tomar fotos y mover su vehículo de la calle, siempre y cuando no haya heridos.
- Los conductores llenaran un Formato Único y Definitivo de Transito, indicando quien se hace responsable. Si no se ponen de acuerdo hay que llamar al tránsito para que el agente elabore el Parte, en base a las fotos y al Formato (Art. 6)
- Si los conductores no mueven sus vehículos, se les multara con $50.00 (art.7)
- El Formato se debe enviar a la Cía. de Seguros para tramitar el Reclamo (art.8)
- Las personas naturales o jurídicas sobre las que recaigan la responsabilidad podrán solicitar el levantamiento del parte policivo dentro de los 8 días siguientes al accidente. En estos casos se remitirá el Parte al Juzgado de Transito ( art.9)
- Después de elaborado el formato la persona tiene 8 días para impugnar el Formato (art.10)
- Pero antes de impugnar el Formato las asegurados deberán evaluar primero el reclamo (art.11)
- Si el automóvil no tiene póliza se le multa con $100.00, si el conductor no lleva copia de la Póliza la multa es de $50.00 y se le retiene el vehículo.

Este decreto comienza a regir a partir de la promulgación.
